Terms of Service

These Terms apply to your use of the “Malody” Service (Service to Set Up and Maintain a Personal AI Assistant). By signing up or using the Service, you are deemed to have read and agreed to these Terms.

1. Definitions and Scope of Services

Malody is a service like done-for-you where we install, set up and administer an AI Assistant (AI Agent) for you on a private server and then connect it to your chat channel (e.g. Telegram/Discord) to assist with secretarial tasks such as recording income, expenses, scheduling appointments, drafting emails, and managing documents.

What's in the service (Malody takes care of it)

  • Set up servers (server/VPS) and take care of the availability of the areas we manage.
  • Install and setup AI Agent software for the first time.
  • Connect your AI Agent to your chat channel
  • Enable basic set of capabilities (account/calendar/email/document)
  • Take care of updates, troubleshooting, and backups at the package level.

Out-of-service items (you are the manager)

  • Languages Model Service Provider (LLM) fees and accounts, such as ChatGPT or Claude, as well as usage credits/quotas — unless Malody is agreed to take care of the credits on a case-by-case basis.
  • Your account or chat channel number (Telegram/Discord)
  • Content validity and decision making based on AI results
  • Information and access to various accounts that you have provided to the system

2. What you need to prepare and your duties

  • Has a subscription or LLM provider credit that supports and maintains sufficient credit for use.
  • Provides the necessary permissions/information to set up accurately and truthfully.
  • Always check AI results before applying. Especially financial, accounting, tax and legal.
  • Use the Services legally and without infringing the rights of others.

3. Service fees and payments

  • Service fee includes One time setup fee (Setup Fee) and Monthly service fee according to the plan you choose
  • Prices shown include 7% Value Added Tax (VAT) — issue a full invoice breaking VAT. In the case of corporate customers who are subject to withholding tax (WHT), please inform in advance.
  • Monthly payments are made through the subscription payment link of the third party payment provider, and the installation fee is charged separately at the start-up stage.
  • The service is a fixed monthly subscription. Cancel anytime, no strings attached. Cancellations will take effect in the next billing period; andThere are no refunds for cycles that have already been paid.

4. Service Level (SLA)

Malody sets uptime targets on a per-package basis for transparency, covering Only the part that Malody manages. (Server and AI Agent software installed by us)

  • Target uptime, first-response time and backup frequency are according to the schedule of each package.
  • These goals are best-effort target For service Not tied to monetary reimbursement (no service credit/no retroactive bill reduction)
  • Ongoing severe outages will be handled with SLA-based modifications and cancellation rights.

5. Disclaimer

“Malody guarantees the availability of AI Agent machines and software in areas only managed by Malody, excludes third-party services (LLM providers, Telegram, Discord, server providers, and payment service providers), and does not guarantee the accuracy of AI-generated results. Users are responsible for reviewing them before implementing them.”

  • If your LLM provider's credit/quota runs out or is suspended, AI will stop working. will not be considered Malody's downtime.
  • Malody is not an accounting, legal, tax, medical, or investment adviser; AI results are informational only.
  • To the extent permitted by law, Malody's aggregate liability for any damages will not exceed the actual fee paid by you in the 1-month period prior to the incident.

6. Suspension and Cancellation of Services

  • You can request to suspend/cancel the Service at any time through the designated channels.
  • Malody reserves the right to suspend the service in case of illegal use, violation of terms or arrears.

7. Information and Intellectual Property

The information and content that you enter into the System is also owned by you. Malody processes the information in order to provide the Services only as specified in the PRIVACY POLICY The Malody developed tools, scripts, and setup methods are also the property of Malody.

8. Changes to the Terms

Malody may update these Terms from time to time and by continuing to provide notice through the website or contact channels, you agree to the new Terms.

9. Governing Law and Contact
